It also describes your choices regarding use, access, and correction of your personal information. Additional terms and conditions may also apply to your relationship with Ambly, depending on how you choose to interact with us. This Privacy Policy applies only to information we collect, process, and use through our Services, and it does not apply to information that we collect through other channels, such as any website or application operated by a third party.

We collect personal information when you access or use our Services. As used in this Privacy Policy, personal information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate a specific individual, such as a name, address, email address, or phone number. We do not consider personal information to include information that has been aggregated and/or de-identified so that it does not allow a third party to easily identify a specific individual.

We collect information, including personal information, when you register with and log in to our Services, use our Services, or communicate with us. Categories and examples of information you may provide include the following:

 

         Profile or contact information such as name, username, password, phone number, email, and third-party login information

         Securities trading information such as historical or prospective securities trading information, risk tolerances, confidence intervals, and other trading parameters related to stocks, options or other securities

         Comments or messages regarding information or content provided by us or other users

Additionally, we cannot control the actions of other users of our Services with whom you may choose to share your User Contributions. Certain information is automatically provided to us and our authorized third parties when you interact with our Services. The information we collect automatically helps us to improve our Services and to deliver a better and more personalized experience to you, including by enabling us to estimate our audience size and usage patterns and store information about your preferences.          Device metrics such as when a device is in use, application usage, connectivity data, and any errors or event failures.

 

We and our authorized third parties may also use device identifiers associated with cookies, web beacons, and similar technologies deployed on our Services as described below.

 

         Cookies (or browser cookies). Like many online services, we use cookies to collect information. “Cookies” are text files containing small amounts of information that are downloaded to your computer or mobile device when you visit a website or mobile application.          Web Beacons. Pages of our Services may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs). In contrast to cookies, which are stored on a user’s hard drive, web beacons are embedded invisibly in web pages.

Our Services may include links to other websites or services, such as to process online payments or create digital content. Personal information collected on other sites and services is subject to the privacy policy and practices of the third party providing such website or service and not this Privacy Policy. If you enter credit card information on our Services in connection with a purchase, that information is sent directly from your browser to the third-party service provider we use to manage credit card processing and we do not store it on our servers.          Third-Party Service Providers. We may share your information with individuals and third-party companies that perform services on our behalf, including for payment processing, order fulfillment, data analysis, marketing services, advertising services, email and hosting services, services that process and administer consumer surveys, and customer services and support. We may also share your information with third-party companies that we partner with to provide certain services to you in connection with the Services. Those partners’ collection and use of information are subject to their privacy policies and other terms.

         Analytics and Data Enrichment Services. We use third-party analytics to help understand your usage of our Services and to improve our Services (e.g., Google Analytics). We may provide your contact information, registration information, technical information, usage data, or de-identified data to data enrichment services, which may match such information with publicly available database information, including contact and social information from other sources, such as your email address, gender, company, job title, photos, website URLs, social network handles and physical addresses. We use this combined information to communicate with you in a more effective and customized manner.

         As Required by Law and Similar Disclosure. We may access, preserve, and disclose your personal information or other account information if we believe doing so is required or appropriate to comply with law enforcement requests and legal processes, such as a court order or subpoena, to enforce our Terms, or to protect your, our, or others’ rights, property, or safety.

         Electronic Communications. We may, from time to time, send you electronic communications (e.g., email or text messages) regarding our products and services, or products and services we think you may enjoy. You can choose not to receive these emails by clicking the unsubscribe link in any email or respond appropriately to any text message. Please note that you may not be permitted to unsubscribe or opt-out of non-promotional messages regarding your account, such as account verification, orders from us, changes or updates to features of the Services, or technical or security notices.

         Third-Party Use of Cookies.  Some content or applications, including advertisements, on our Services are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used.          Email. As described above, if you do not wish to receive promotional emails from us, you may opt out at any time by following the opt-out link contained in the email itself. Please note that it may take up to ten (10) days to process your request. Please also note that if you opt out of receiving marketing communications from us, we may continue to send to you service-related emails which are not available for opt-out. If you do not wish to receive any service-related emails from us, you have the option to delete your account.

         Cookies. You may also refrain from providing or may withdraw your consent for cookies via your browser settings. Your browser’s help function should contain instructions on how to set your computer to accept all cookies, to notify you when a cookie is issued, or to not receive cookies at any time. Please keep in mind that certain cookies are required to authenticate users as well as perform some actions within Ambly, so to use our Services, some strictly necessary cookies are required.

         Third-party analytics and advertising services. Some of our third-party service providers provide the ability to opt-out.

         Google Analytics. You may opt out of Google Analytics’ services using the Opt-Out feature on their website. The Google Analytics service is provided by Google Inc. How To Access, Update, or Delete Your Personal Information

 

You may update certain account information using your account. You may also contact us at support@ambly.io to update or delete your personal information.

 

We may not be able to delete information in all instances, such as information retained in technical support logs and other business records. We may retain information which has been de-identified or disassociated with personal identifiers such that it can no longer be used to reasonably identify a particular individual.

 

Childrens Privacy

 

We do not aim any of our products or services directly at children under the age of 13, and we do not knowingly collect personal information about children under 13.

 

International Users

 

Ambly is not currently intended for use by persons outside of the United States, and such use is in violation of our Terms of Use at https://ambly.io/terms. To the extent Ambly inadvertently collects personal data from users outside the United States, the following policy applies.

 

A.     Legitimate Purpose

 

In respect of each of the purposes for which we use your personal information, the General Data Protection Regulation (GDPR”) requires us to ensure that we have a legal basis for that use if you are within the European Union (EU”). The legal bases depend on how you use our Services. This means we collect and use your personal information only where:

 

         we need it to provide you the services we offer, including to operate Services, provide customer support and personalized features, and to protect the safety and security of Services;

         it satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Services, and to protect our legal rights and interests; or

         we need to process your personal information to comply with a legal or regulatory obligation.

 

We may also rely on your consent as a legal basis for using your personal information where we have expressly sought it for a specific purpose. This Privacy Policy is subject to occasional revision, and if we make any material changes in the way we use your personal information, we will notify you by sending you an e-mail to the last e-mail address you provided to us (if any), and/or by prominently posting notice of the changes on our Services. You are responsible for providing us with your most current e-mail address. If the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice.
